Where Can I Build In My Garden Without Planning Permission?

Though adding a new structure to your garden is an exciting process, some people are put off by the prospect of needing planning permission. This is understandable. However, the good news is — it isn’t always necessary.

Do You Need Planning Permission for Gardens?

If you own your property, you can do what you like with your garden — just within reason. If you’re hoping to create a bountiful vegetable patch, plant your favourite flowers, or do a touch of landscaping, go for it! 

Nevertheless, if you’re looking to add a structure to your garden, you’ll either need to abide by permitted development rules or seek planning permission. Permitted development restrictions will limit where in your garden you can build your garden office, so you’ll need to look at them carefully and work out what they mean for you.

How Big Can an Outbuilding be Without Planning Permission?

If you want to skip the (sometimes lengthy) process of getting planning permission, stick to these rules:

  • Outbuildings and garages should be single-storey with a maximum eaves height of 2.5 metres. They must have a maximum overall height of four metres with a dual pitched roof or three metres for any other roof.
  • There is a maximum height requirement of 2.5 metres in the case of a building, enclosure or container within two metres of a boundary of the curtilage of the dwellinghouse.
  • No more than half the area of land around the “original house” can be covered by additions or other buildings.
  • In National Parks, the Broads, Areas of Outstanding Natural Beauty and World Heritage Sites the maximum area to be covered by buildings, enclosures, containers and pools more than 20 metres from the house to be limited to 10 square metres.

What Can You Build in Your Garden without Planning Permission?

In terms of what you can build, you have a lot of freedom. Whether you’re after a greenhouse or playhouse, shed or sauna room, these can all be constructed (so long as you stick to the rules).

Whatever you build, keep in mind:

  • There must be no outbuilding on land forward of a wall forming the principal elevation.
  • You can have no verandas, balconies or raised platforms (a platform must not exceed 0.3 metres in height).

Plus, regardless of the type or size of outbuilding you have in mind, note:

  • On designated land buildings, enclosures, containers and pools at the side of properties will require planning permission.
  • Within the curtilage of listed buildings any outbuilding will require planning permission.
